By using this website operated by The Air Lab, Inc. d/b/a Windmill (“Windmill”, “we”, or “us”), and purchasing a product or service, you agree to these Terms of Sale and all other terms that we may post. Please read them carefully.

PRODUCT AND SERVICE DESCRIPTIONS
We try to provide accurate depictions and descriptions of our products and services; however, we do not guarantee that descriptions, colors, dimensions, details or other content on our website are accurate, complete, reliable, current or error-free. If a product offered on this website is not as described, your sole remedy is to return it in unused condition (except products that are not eligible for return). Colors and other details that you see on your device may vary from the actual product. We cannot guarantee that your device will accurately display the details of our products and services.

PRICING INFORMATION
We cannot confirm the price of an item until you have placed an order. Pricing errors may occur on our website. We reserve the right to cancel any orders containing pricing errors, with no further obligations to you, even after your receipt of an order confirmation or shipping notice from us. We may, at our discretion, contact you for instructions or cancel your order and notify you of such cancellation.

NO PURCHASES BY MINORS
The shopping cart and checkout features of this site are intended to be used by persons who have reached the age of majority in their place of residence (18 in most states).

ORDER ACCEPTANCE AND BILLING
By confirming your purchase at the end of the checkout process, you agree to accept and pay for the product(s) and service(s) ordered.

You must provide truthful and accurate billing information. Providing any untruthful or inaccurate information may result in order cancellation. Before we accept and process an order, we may also request that you provide additional information. We reserve the right to refuse or cancel an order for any reason, including limitations on quantities available for purchase, inaccuracies or errors in product or pricing information, or problems identified through our efforts to avoid fraud and/or account abuse.

We reserve the right to limit availability of, and/or to discontinue or terminate, any content, product, service, or other feature described or available on our website to any person, entity, geographic area, or jurisdiction, at any time and in our sole discretion, and to limit the quantities and/or cancel orders of any content, product, service, or other feature that we provide.

If your order is canceled after your credit card (or other payment account) has been charged, we will issue a credit to your credit card (or other applicable payment account) in the amount of the charge. We will contact you if all or any portion of your order is canceled or if additional information is required to accept your order.

QUANTITY LIMITS
We reserve the right to limit quantities available for purchase for any reason. Quantity limits may be applied per order, per person or household, or to orders that use the same credit card, billing and/or shipping address, or share any other account or order attribute. Users who attempt to circumvent quantity limitations (e.g. by using multiple email addresses or accounts to order more than a stated limit or by placing multiple orders of the same product) may have orders denied and their accounts suspended from further activity.

PROMOTIONAL CODES
Promotional codes are limited in nature, void where prohibited, and may expire or be discontinued with or without notice. Promotional codes may not be copied, sold, shared with other, or applied to prior or future purchases. They are not redeemable for cash and are subject to cancellation or change at any time for any reason. Items eligible for promotional discounts may be limited to stock on hand.

RETURNS AND WARRANTIES
If you are not satisfied with an item you have purchased, you may return the item within thirty (30) days of delivery for a full refund of the purchase price, excluding shipping, handling, and other charges, unless Windmill explicitly states it will cover such charges. The item must be returned in good condition, in original or similarly appropriate packaging, and with all paperwork, parts and accessories to ensure credit. We do not take title to returned items until we receive them, which determines the thirty (30) day window from delivery. Items designated as final sale may not be returned. If a product is returned in damaged condition, with missing parts, or otherwise has signs of abuse, we reserve the right to refuse a refund or to charge additional restocking fees, at our sole discretion.

 

SHIPPING AND DELIVERY
Unless otherwise explicitly stated, all shipping charges relating to your purchases through the website will be disclosed in the ultimate purchase price. Title and risk of loss for purchased items pass to you upon our delivery to the carrier. Windmill does not deliver to addresses outside the United States.

TAXES
You are responsible for paying all sales, use and other taxes, including any applicable duties, relating to any of your purchases of products or services from Windmill through this website.

 

WINDMILL SUBSCRIPTIONS

Our products contain one or more air filters that should be replaced with new, fresh ones from time to time as indicated (“Filters”). When making a purchase on our website, you will have an option, but not obligation, to purchase subscription(s) to Filters with automatic, recurring charges and shipment of a certain amount of Filters at a certain cadence (“Subscription”). Depending on the product and our offerings, you may also have the option of making one-time payments for certain Filters.

 

Each Subscription includes the specified number of Filters in each filter pack as indicated during the time of purchase, which will be shipped out within a reasonable amount of time post-checkout subject to the shipping and delivery terms laid out during checkout; such filter pack will then ship again on a recurring basis anywhere from six (6) to twelve (12) months from that point and going forward until such Subscription is cancelled.  BY USING OR PURCHASING SUBSCRIPTIONS, YOU AUTHORIZE WINDMILL TO INITIATE RECURRING NON-REFUNDABLE PAYMENTS AS SET FORTH BELOW.

 

If you purchase Subscriptions, we (or our third-party payment processor) will automatically charge you, on or around the time of the shipment of each Subscription pack of Filters during the then-current renewal period, using the payment information you have provided until you cancel your Subscription. Your Subscription will automatically renew at least once every twelve months (according to the Subscription option chosen during checkout or purchase), and your credit card will automatically be charged the full amount, plus any applicable taxes and other charges, on or around the shipment of each Subscription pack of Filters. YOU MUST CANCEL YOUR SUBSCRIPTION AT LEAST FIFTEEN DAYS PRIOR TO THE SHIPMENT OF EACH SUBSCRIPTION FILTER PACK TO AVOID THE BILLING OF FEES.

 

You acknowledge that your Subscription has recurring payment features and you accept responsibility for all recurring payment obligations prior to cancellation of your Subscription. Your Subscription will continue until cancelled by you or until we terminate your access to or use of the services in accordance with these Terms of Sale. You can cancel your Subscription at any time by following the applicable instructions on the website or by contacting us at support@windmillair.com. Cancellation will be effective at the end of the then-current renewal period. UNLESS OTHERWISE EXPLICITLY STATED, YOU WILL NOT RECEIVE A PARTIAL REFUND FOR ANY PORTION OF THE SUBSCRIPTION FEE PAID FOR THE THEN-CURRENT SHIPMENT AT THE TIME OF CANCELLATION.
